Terms of Service

These terms govern the use of this website, the quote request service, and the client portal.

Services

OKTAVE provides custom software development services (web, desktop, and embedded). This website provides information about those services, a quote request form, and a client portal.

Quotes

Quote requests and the estimates we return are non-binding until a separate written agreement is signed. Statuses shown in the portal are informational.

Accounts

You agree to provide accurate information and to keep access to your sign-in email secure. Accounts used for abuse may be suspended.

Acceptable use

You may not use the service unlawfully, or for abuse, reverse engineering, unauthorized access, overloading, or uploading harmful content.

Intellectual property

Ownership of deliverables passes to the client on full payment. OKTAVE retains its pre-existing IP, tools, libraries, and know-how (a non-exclusive license may be granted). Website content belongs to OKTAVE.

Confidentiality

OKTAVE treats client Gerber files, source code, data, and business information as confidential, uses them only to deliver the service, and protects them with reasonable technical and organizational measures. A separate NDA may be signed.

Disclaimer of warranties

The website and free tools are provided "as-is" to the maximum extent permitted by law, without express or implied warranties. Contracted deliverables are warranted as set out in each project agreement.

Limitation of liability

To the maximum extent permitted by law, OKTAVE's total liability is capped at the fees actually paid for the service giving rise to the claim, and OKTAVE is not liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, data loss, business interruption). Mandatory exception: consumer law, gross negligence/wilful misconduct, and mandatory EU/local rules may override these limits.

Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control (disaster, war, infrastructure or third-party outages, legal changes).

Governing law
